TERMS AND CONDITIONS

All items produced by Passion Studio (including original music edits, choreography, creative concepts, costumes, props and sets) remain the property of Passion Studio and cannot be replicated or reproduced. All dance teaching staff are appropriately qualified and skilled in the delivery of dance. Passion Studio will not be held responsible for any injuries which may occur whilst in class or on the premises at 1/594 Elizabeth St Melbourne.

You are required to treat all persons and property at Passion Studio with all due care and respect.

We recommend you refrain from bringing any valuable personal belongings to Passion Studio. We are not responsible for any loss or damage to personal belongings.

You must inform us and our instructors if you have any injury, illness, discomfort before participating in any class. Passion Studio staff are not medically trained so it is up to the discretion of the member to ensure they are fit enough to participate in a class. Passion Studio will not be held liable for any injuries sustained in class.

The sale of each Membership is subject to specific terms and conditions applicable to the type of membership which you hold, part of which can include a minimum membership commitment period (e.g. Unlimited Pass required a minimum 3 month commitment), automatic direct debit, membership time limitations and/or class attendance limitations.

We use a third party client management software known as “Clubworx”. In order to create a Student Membership, your personal information will be provided to the proprietor of Clubworx.

All members will adhere to the General Conditions of Entry & Class Attendance regulations

We reserve the right to change our fees applicable to the Student Memberships at any time. We will notify you of any changes to the pricing in writing.

The timetable is subjected to change of teacher or cancellation of class. Refunds, transfers, extensions of passes will not be permitted when there is a change/amendment to the timetable.

If you are exhibiting any anti-social, dangerous, concerning behaviour, Passion Studio staff have the right to ask you to leave the premises. Failure to comply will result in police involvement.

Members can only use a pass that is registered to their name. Members cannot use their own pass for family, friends or other people. If this clause is violated, Passion Studio has the right to charge fees at their own discretion, has the right to remove member for any booked classes & suspend account until further notice.
Suspension/extensions/cancellation of direct-debit memberships (Unlimited Pass)

Suspensions are not permitted until the minimum 3 month commitment has been fulfilled.

If a member wants to cancel the Unlimited Pass before the 3 month commitment has been met, they are required to pay the outstanding balance left on the Unlimited Pass (e.g. if a member wants to cancel after 1 month, they must pay the remaining 2 month balance)

The Unlimited Pass can only be suspended/cancelled by email request. Suspensions/cancellations will not be accepted via Facebook, Instagram, telephone, in person or any medium other than via email.

The suspension may be for a minimum of one week for any single suspension period.

The Unlimited Pass can be suspended up to 10 weeks per year (from start of their membership) once the minimum 3 month commitment has been met.

Members must provide 1 week's notice for any suspension or cancellation. This must be done via email.

The Unlimited Pass will continue after the minimum 3 month commitment unless a member emails to request suspension. It is not assumed that the membership will automatically be cancelled after the 3 month minimum commitment.

All members must respect the cancellation policy. Members can cancel up to 4 hours prior to the start of the booked class. A late cancellation will incur a fee of $10.00.

All members must respect the absent policy. If a member does not attend a booked class, a $10 absent fee will be charged to the nominated payment method.

Class Attendance

To ensure you can attend a class, it is recommended you pre-book your attendance to any classes held at our studio using the online booking system (Passion Studio app or Member Portal)

Members must tick their name off at reception for each class they are booked into; failure to do so will mean member is marked Absent and this will incur a $10 fee
Cancellation of classes
-
Members can cancel classes at no charge prior to the late cancellation window
-
The late cancellation window is within 4 hours of the class start time e.g. if you want to cancel 6:30pm Monday class, you can do this at no charge before 2:30pm that day. A cancellation after 2:30pm on the day of the class will incur a $10 late cancellation fee.

We will apply a $10 penalty for late cancellation or a no show, to your Student Membership account. Once you incur any penalty, your entitlement to book and attend any Classes is suspended until the penalty has been paid in full. This will be charged within 7-14 days by Ezidebit.

Members must cancel classes via their member app or member portal. Cancellation via email request will not be accepted.

Members will a Single Pass, 5 Class Pass or 10 Class Pass will not have a class deducted if they cancel late or are marked absent. Only a fee is applied so their pass will be returned to their account.
Payments
Membership fees for the Debit Memberships will be charged to a holder’s nominated credit card or bank account once per week or fortnight (depending on the Students’ payment frequency) via a third party payment provider (Ezidebit)

It is the holder’s responsibility to ensure there are sufficient funds available in their nominated bank account or credit card to cover the applicable fees for the Debit Memberships. If a payment is declined for any reason, Passion Studio reserves the right to process payment anytime where sufficient funds are available in the nominated bank account or credit card in order to settle any fees that are owed. If an auto- debit is declined due to insufficient funds, Ezidebit will charge $14.80 for any failed transactions. This fee will be debited 7-14 days after the failed payment.

Members can view upcoming, failed and processed payments via their Passion Studio app under ‘Payments’ section - it is recommend this is monitored regularly to ensure there are appropriate funds in member nominated payment method.

Passion Studio is in no way responsible for additional fees that a holder may incur from their bank in relation to processing payment of fees for Debit Memberships.

To change a payment method, an email must be sent to info@passionstudio.com.au and Passion Studio will send member an ‘Existing Member Waiver’ to update payment information.
Refunds
We do not provide refunds for purchased passes. - Passes are not transferable to other members

GENERAL CONDITIONS OF ENTRY & ATTENDANCE

Passion Studio reserves the right to refuse entry to, or eject you from, any of our Studios for any reason. We will refuse entry or eject you in the event that you are behaving in an anti-social, intoxicated, disorderly, aggressive, offensive or dangerous manner or in any manner which may threaten the security of our Students or other people at the Studios.

You must present your Student Membership pass or valid photo identification (Australian driver’s licence, passport or proof of age card will be accepted) to reception staff upon entry to the Studios. We reserve the right to refuse entry to persons without suitable ID.

We make every possible effort to deliver our Services through classes in accordance with our class schedule. Class schedules are subject to change or cancellation and we are not required to provide notice to you or such changes. We are not liable in any way to provide you with a refund, credit, transfer, or to offer compensation of any kind, for classes that are not held in accordance with the class schedule, including without limitation any classes that are changed or cancelled.

Passion Studio and its instructors are not medically trained and are therefore not qualified to assess whether students are in good physical condition and/or that students can engage in active or passive exercise without detriment to their health, safety, comfort or physical condition. Students are advised to seek medical advice prior to commencing any exercise program if they are in any doubt about their ability to engage in exercise. Participating in any form of exercise at our studio is done entirely at your own risk.

Students are required to wear appropriate attire for physical exercise at all times while visiting our Studios, and must refrain from wear clothing which contains offensive prints or designs.

Students are required to conduct themselves within a class in a manner which is respectable and considerate to other Students attending the class. Students must not behave in an anti-social, intoxicated, disorderly, aggressive, offensive or dangerous manner or in any manner which may threaten the security of our students or other people at Passion Studio.

Smoking is prohibited inside and out the front of our Studios at all times.

Student Memberships are sold or otherwise provided to patrons of our studio for personal use only. Student Memberships are non-transferrable and must not be sold, traded, gifted, shared, provided or otherwise transferred to any other person. If we discover that you are engaging in any of these activities, we reserve the right to cancel your Student Membership permanently and ban you from visiting Passion Studio indefinitely.

During and/or at the end of a class or event, a Passion Studio staff member may film the class for promotional purposes (social media or other). If a member is not comfortable with being filmed, a member will take initiative themselves to step out of class or to the side. We reserve the right to use the videography for promotional purposes.
